Use MakeTheForm to receive form submissions. Do not use it to send spam, phish people, or attack anyone. Your submissions are yours, and you decide what your forms collect, which also makes you responsible for collecting it lawfully.
Paid plans renew until you cancel, and cancelling keeps your access until the period you paid for runs out.
01The agreement
These terms cover your use of MakeTheForm, including the dashboard, the submission endpoints, and the API. By creating an account or sending a submission to an endpoint you agree to them. If you are agreeing on behalf of a company, you confirm you are able to bind that company.
02Your account
You need an account to create forms. Keep your credentials secure, because activity under your account is your responsibility. Tell us promptly if you think someone else has access to it.
You must be old enough to enter a contract where you live, and you must not use the service if we have previously terminated your account for a breach of these terms.
03Your data and your visitors
Submissions belong to you. We store and deliver them on your behalf and claim no ownership over them. We use them to run the service and for nothing else.
Because your forms decide what is collected, you are responsible for the lawfulness of that collection. In practice that means:
- telling your visitors what you collect and why, and having a lawful basis for it;
- not collecting categories of data you are not equipped to handle, including payment card numbers, government identifiers, and health records;
- responding to your visitors when they ask you to access or delete what they submitted.
The privacy policy sets out how we handle data on your behalf.
04Acceptable use
You agree not to use MakeTheForm to:
- send unsolicited bulk email, or collect addresses in order to do so;
- phish, impersonate another person or organisation, or collect credentials under false pretences;
- host or distribute malware, or use an endpoint as a relay for attacks against a third party;
- deliberately circumvent plan limits, rate limits, or spam controls, including by spreading one workload across multiple accounts;
- break the law, or infringe someone else’s rights.
Endpoints are public by design, so we take abuse seriously. If a form is being used for any of the above we may disable it without notice.
05Plans, limits, and billing
Plan prices, submission allowances, retention windows, and feature limits are set out on the pricing page, which is the authoritative description of what each plan includes.
Paid plans bill in advance for the period you choose and renew automatically until you cancel. Cancelling stops the next renewal and leaves your access running until the end of the period you have paid for. We do not generally refund partial periods.
If you exceed your plan’s allowance we will tell you in the dashboard and by email. We would rather warn you than silently drop submissions, but sustained overage on a free plan may result in rate limiting.
We may change prices. If we do, we will give notice before the change applies to your renewal.
06Availability
We work hard to keep the submission endpoint available, and we treat it as the most critical part of the system: it is designed so that a submission is stored the moment it is accepted, before any notification is attempted. Current status is published on the status page.
We do not offer a contractual uptime guarantee on the free plan. Planned maintenance will be announced where it is likely to be noticeable.
07Suspension and termination
You can close your account at any time from the dashboard. Doing so deletes your stored submissions, so export anything you need first.
We may suspend or terminate an account that breaches these terms, that is being used abusively, or where non-payment is unresolved. Where circumstances allow we will warn you first and give you a chance to fix the problem. For serious abuse, particularly phishing or attacks on third parties, we will act immediately.
08Warranties and liability
The service is provided as is. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for indirect or consequential loss, or for lost profits, revenue, or goodwill. Our total liability in any twelve month period is limited to the amount you paid us in that period.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.
09Changes to these terms
We may update these terms. If a change is material we will update the date at the top of this page and notify account holders by email. If you keep using the service after a change takes effect, the updated terms apply to you.
